Fries, a farmer, received a notice from the manufacturer of a farm harvester that a cable on the machine was defective and likely to snap. Fries ignored the warning, and two weeks later the cable snapped and cut off one of his employee’s arms. OSHA initiated proceedings to fine Fries for failure to correct the defect. Can it do so, as farming operations were exempted from OSHA regulation?
