The Warsaw Convention for the Unification of Certain Rules Relating to International Carriage was adopted in 1929. It established the principle of the air carrier's liability for damage caused to passenger, baggage and cargo, and for damage caused by delay. In 1999, the ICAO adopted the Montreal Convention for the Unification of Certain Rules for International Carriage by Air improving on the Warsaw Convention and vastly modernizing the unification of private air law.
Singapore has adopted into their legislation the entire text of the Montreal Convention with the object of regulating its national air transport. The main feature of the liability regime of the carrier under the Montreal Convention is the two-tier liability system for death or wounding of the passenger. A new first tier was introduced to include strict liability and presumptive liability (with a reversed burden of proof) for claims below certain limits.
