As discussed in Chapter 6, as part of the effort to curb excessive tort litigation, many states have enacted limits on the amount of general noneconomic damages that can be awarded. (Noneconomic damages include damages for pain and suffering, emotional distress, inconvenience, physical impairment, disfigurement, and the like.) Some states also specifically limit damage awards in medical malpractice (professional negligence) cases.
