Police officers in Cincinnati claimed that under the Fair Labor Standards Act they should be paid time and a half overtime for working more than a 40-hour workweek. The city claimed that overtime pay would create a budget deficit and an undue burden. The statute does not consider payment of overtime an undue burden.
