a. A plaintiff’s attorney loses a case, and she believes that her loss is due to prejudicial jury instructions given by the judge.
b. The defendant’s key witness died during trial, and there was no way to obtain the testimony he would have provided. As a result, key evidence was not presented, and the defendant was unable to prove his case.
c. In the same case (see Question 2b above), the plaintiff’s attorney made an appropriate motion, which was not granted, and ultimately lost the lawsuit. Thus, according to the plaintiff’s attor ney, the judgment was not supported by the evidence.
