Jeffrey Sammak was the owner of a contracting business known as Senaco. Sammak decided to enter the coal reprocessing business. Sammak attended the Coal Show in Chicago, Illinois, at which he met representatives of the Deister Co., Inc. (Deister). Deister was incorporated under the laws of Pennsylvania. Sammak began negotiating with Deister to purchase equipment to be used in his coal reprocessing business. Deister sent Sammak literature, guaranteeing a certain level of performance for the equipment. Sammak purchased the equipment. After the equipment was installed, Sammak became dissatisfied with its performance. Sammak believed that Deister breached an express warranty and wanted to sue.
