A few states have recently enacted statutes removing any duty to retreat if a person is attacked in a vehicle where he or she has a right to be. Some allow a person attacked to presume the attacker intends to do bodily harm and allows the vehicle occupant to use any force necessary in defense, with no duty to retreat.
