Murphy is currently employed within the Foreign Bureau of Information Services component of the CIA. He has access to a government computer system owned and operated by the CIA and access to the Internet. An examination of the company’s firewall logs revealed that a number of Websites were repeatedly accessed at Murphy’s workstation. The sites were characterized by a systems manager as not “necessarily for business purposes.” On orders from his supervisors, the systems manager copied the contents of Murphy’s workstation hard drive for investigators to review and then discovered that Murphy had downloaded files containing child pornography. Murphy argues that the systems manager’s search was in violation of the Fourth Amendment because it was conducted without a warrant or other lawful justification. Should the CIA be permitted to continue its investigation into Murphy’s conduct? Why?
