Marjorie Reiley Maguire was a professor in the theology department at Marquette University, a Roman Catholic institution. Approximately half of the twenty-seven members of the department were Jesuits, and only one other member was female at the time Maguire came up for tenure. The school denied her tenure because of her pro-choice view on the abortion issue—that is, because she favored personal choice rather than the Church’s strict ban on abortions.
