When Wilson and his passenger Davison were injured in an automobile accident, the insurance company stated that the policy on Wilson excluded coverage of more than one person in a single accident. Davison sued, contending that because the exclusion of coverage in the policy was not in a different color or type than the rest of the policy as required by state statute, the term was void. The insurance company pointed out that although the exclusion did not appear in a different color or type of print, it was in a section of the policy clearly labeled “exclusions.” Should Davison be allowed to collect?
