Lafarge Canada Inc developed plans to build a new set of docks in Vancouver’s harbour. The land was owned by a federal body named the Vancouver Port Authority (VPA). The VPA was created under a federal statute called the Canada Marine Act. The VPA’s purpose was to ensure that various aspects of the shipping industry worked effectively in Vancouver’s harbour. The VPA gave its approval to Lafarge. The project was opposed, however, by a citizens’ group, which argued that the project could not proceed because it had not received city planning approval.
