The plaintiff, Judy Saumer, was employed by the defendant placement agency, operating under the name "Temporarily Yours," as a service coordinator, filling clients' short-term positions with temporary employees. She was promoted to branch man- ager in 1987 and was responsible for the overall running of the branch as well as maintaining direct contact with clients. On returning from her annual vacation, the plaintiff found that her personal effects had been removed from the office, and her employer promptly advised that she was dismissed from her position. Saumer then commenced a wrongful dismissal suit. seeking damages. The defendant countered that the plaintiff had been dismissed for cause, Ms, Braun claimed that the plaintiff had lied and cheated a major client, thus destroying the trust the client had in the firm. While the plaintiff was away on vacation, Ms, Braun assumed her responsibilities. It was then that she discovered that the plaintiff had failed to provide a temporary employee for a major client, Gulf C'mada, and had then attempted to deceive the client by denying that any order had been placed. The truth was unravelled, however, when Gulf contacted the temporary employee, whom the plaintiff had contacted in trying to fill Gulf's temporary position, and that individual admitted that the plaintiff had called her about filling Gulfs position. Ms. Braun had also discovered many other instances where the plaintiff had failed to perform required duties The Court held that this failure to follow up with clients did not amount to "sufficient grounds to justify dismissal without notice. But the manner in which the Gulf account was handled, including deception and lies, gave the employer good reason to lose confidence in the plaintiff as manager of the business.
