1. An MET airline company in financial difficulties was making a number of its pilots redundant. The airline company agreed with the Indian Airline Pilots Association to pay each pilot an 'ex gratia payment' equivalent to the company's contribution to the pension fund, upon being made redundant. This was initially the subject of a resolution of the company's Board, and agreed upon at a meeting between the company's representatives and the Association's representatives. The Rakesh opted to leave the company and Rakesh was made redundant by Company. He had been informed by his pilots association that he would be given an ex gratia payment (ie, a gift) but his pilots association failed to pay the amount. Now pilot Rakesh want to sue for breaching the contract and claiming an ex gratia payment. Advice pilot Rakesh. [marks 4]
