1. Edgewater Motels, Inc v Gatzke and Walgreen Company: Gatzke worked as a district manager for Walgreens. He was staying at the Edgewater Motel while he was working in Minnesota "on call 24 hours a day" for Walgreens. A fire occurred in his hotel room from a lit cigarette he dropped into the waste paper basket. The fire caused massive damage and Edgewater sued both Gatzke and Walgreens. Both were found liable for the damages.

Why do you think Walgreens would be responsible for the action of Gatzke. Was he still working when the fire took place? Can you make an argument that Walgreens is not liable?

2. Siegenthaler v Johnson Welded Products, Inc: Spires was an employee of Johnson Welded Products. During his lunch break he drove his car to a friend's house and got into an accident with the plaintiff.

Is Johnson liable? Why? Why not?

3. Desert Cab Inc v Marino - Marino worked for Yellow-Checkered Cab and Edwards worked for Desert Cab. Both were waiting for customers outside a casino hotel when they got into an argument. Edwards then became physical and choked Marino. Edwards was found guilty of misdemeanor assault and battery.

In a civil suit, is Desert Cab liable as well? Why or why not?

4. Collette v Unique Vacations Inc: Collette booked a vacation to a Sandals resort that had a hurricane guarantee. Unique Vacations acting as the booking agent for Sandals as stated on the brochure, booked the vacation. A hurricane hit while on vacation effectively wiping out their trip. When Collette got home and called Sandals they were not satisfied and when they contacted Unique, it refused to help citing the Sandals guarantee. They sued Unique Vacations.

Will Collette be successful against Unique? Why? Why not?
