Jae was Quinn's stockbroker and financial advisor. Quinn owned five acres of property. Jae advised Quinn to sell the property to Asa at a price slightly below the market value. Jae recommended that Quinn buy stock with thr proceeds. Quin sold the property to Asa and now wants to have the transaction set aside on the belief that Jae unduly and improperly influenced the decision to sell the property. Jae and Asa are very close friend.

Law

Statutory law (96-4-4-1, of the state statutes) provides that a contract for the sale of land maybe set aside if it is entered into under undue influence.

Case law

Lorn v. Bell.In a fact situation similar to Quinn's, the court ruled 96-4-4-1, undue influence occurs when:
