Discuss whether a contract is made under the following situation and you may [32 marks] support your discussion with relevant case judgment, if any: - a) LSC Development (LSCD) advertised in the local newspaper the tender notice for a housing project. Bena Construction Sdn. Bhd. (BCSB) saw the advertisement and submitted his tender by post to LSCD. LSCD accepted the tender by a letter sent by post to BCSB but with some new terms and conditions. b) LSC Development (LSCD) sent a letter by post to Bena Construction Sdn. Bhd. (BCSB) accepting the tender on 11 Jan 2021 which reached BCSB on 15 Jan 2020. After checking his financial situation, LSCD found that he cannot proceed with the project, so he revoked his acceptance by a letter sent by express mail on 13 Jan 2021 and it was delivered to TCSB on the evening of 14 Jan 2021. c) Bena Construction Sdn. Bhd. (BCSB) promised to pay subcontractor if he installs the firefighting system for the LSC Development (LSCD)'s premises. The subcontractor carried out the works but BCSB did not disburse to subcontractor the promised payment. LSCD promises to compensate the subcontractor on account of his installation. d) Sally, an old lady who is staying with her niece, feels that her niece has been taking advantage of her. The niece, Sarah, have managed to convince her to sell her a piece of land to LSC Development (LSCD) at a low price.
