1. In this scenario, a good topic to start with would be why did Blackwood not have a professional enough reasoning for not hiring Bennett for the manager position, even though management liked her work. Just because "you don't look the part" is not a good reason. He also states that her attitude towards men was perceived as being "too assertive" which is a problem, however, there is no evidence of that.

A good topic for this scenario would be, why was Bennett fired? From the information provided by the client, it seems like she got fired more so for her looks. It is noted that Yardly would criticize her work constantly, but there is no evidence that she was doing a bad job. In the beginning of this scenario, it was stated that Bennett received nothing but superior evaluations from her supervisors when she first started. Which eventually led to her promotion as acting manager two years later. So why would she get criticized and fired now?

Another topic we could use is, why do male employees receive one year's salary with their severance packages, but Bennett only received six months' salary on hers.

Finally, it is stated that Bennett is having to see a doctor for physical and mental side effects from the stress of everything involving the job, the termination, etc.

2. For the first topic, we could use this to get an exact answer as to why Blackwood did not feel like Bennett was right for the manager position, if he comes up with the same answer of "not looking the part" we can use that in court to show it was not a fair reason for termination.

For the second topic, we could use a request for admission, that way we can figure out what the true reason was for Bennett's termination. Again, why was she terminated if she had been doing so well before Yardly came in? Just firing Bennett out of nowhere is very questionable, and we need to find out the truth behind it.

For the third topic, we could use a request for the production of documents, ESI, and tangible things. We could use this request to look back at past employee's severance packages and compare whether all men and women terminated in the past had one year's salary, or if only men had the one year's salary while women only had six months' salary.

Finally, we could use a request for a physical and mental examination for the last topic. The information given states that Bennett is seeing a doctor for physical and mental side effects from stress that she has from going through this. Because of this, we could potentially confirm this stress really does stem from everything Bennett has suffered from this job.
