To delay state court proceedings, Cortes filed a personal bankruptcy petition in federal bankruptcy court. Ownership of the shares of Solar Resources, Inc., from Cortes passed to the bankruptcy trustee, but Cortes ignored him. He called a meeting of the shareholders of Solar Resources, Inc., except for Santiago, and voted for those shares to remove Santiago from the board and elect himself chairman, president, chief executive officer and treasurer. The board of Solar Resources, Inc. then dismissed all of Solar Resources, Inc.'s claims against Cortes in his lawsuit with Santiago.
