1.Kay wished to buy antique vase worth RM 200,000. To raise the money, she applied to the Kaya Bank for a loan of RM 150,000. The bank informed Kay that it would make a loan provided that it received a satisfactory report from an antique valuer, Mimi, whom the Bank had retained to provide such valuation. Mimi was negligent in failing to notice that the antique vase was only a normal vase, which was worthless. She gave the Bank a report valuing the antique vase at RM 200,000. Kay has now discovered that the vase is worthless. Advise her as to whether she is entitled to recover her losses from Mimi.

2.Nic was a trainee fireman. One day, he was instructed by his instructor, Mike, to drive a fire engine at high speed along the countryside accompanied by loud sirens. The purpose of the loud sirens was to give precaution to other road users that a fire engine was nearby. Bini, the driver in front of Nic was agitated by the loud wailing noise of the sirens. Nic could see that Bini was agitated but he refused to slow down. He drove faster in order to overtake Bini's car. As a result, Bini lost control of her car and the car hit a lamppost. Bini was injured and were sent to the hospital. The ambulance that carried Bini to the hospital met with an accident. Bini suffered additional injuries. Advise Bini as to whether she will succeed in suing Nic for the injuries that she suffered.
