According to these scholars, it only gained its legal validity as time progressed. In addition, we know from the previous paragraph that desegregation took time to put into practice. Case outcomes are usually a result of either an interpretation of law or a change in society. If all of this is true, this is an unusual case in that it went against law (allegedly, but assume this is true for purposes of this discussion) and social change at that time. In your opinion, why do you think the Supreme Court justices decided it was the time to rule that segregation was unconstitutional? The law and society were not in line with their views at that time, so why have a favorable ruling then instead of waiting for society to align with the court's viewpoints? What past experiences or current events do you think influenced the Court's decision?
