1) Martha Christiansen owns formal women's apparel stores bearing her name in New Seabury, Massachusetts; Lake Placid, New York; Palm Beach, Florida; and Palm springs, California. At a meeting with her four store managers, she discussed styles she thought appropriate for the forthcoming season, advised them as always to use their best judgment in the goods they purchased for each of their respective stores, and cautioned "but no denim outfits." Later Jane Farley, the manager of the Lake Placid store, purchased a line of inexpensive blue denim outfits from Women's Wear Inc., for the summer season. Women's Wear Inc. knew Martha's apparel stores only sold high- quality formal and business wear. The denim outfits did not sell. Martha refused to pay for them, contending that she told all of her managers "no denim outfits". Women's Wear sued Martha for breaching the contract to purchase the denim outfits. What legal argument will Women's Wear use to support the conclusion that Jane had the authority to purchase the Jeans as the agent for Martha. Is Women's Wear likely to win the case
