She has used the products as prescribed but the hope that she will get her money back and RM200 cash as promised but the company refused to entertain her on the basis that the advertisement was a mere marketing gimmick and simply an invitation to treat only. Unhappy with the situation, Nanisha comes to see you seeking legal advice. Advise Nanisha on the following issues: a) Explain the applicable law that Nanisha can seek for protection. (25 marks) 2. Brahim bought a second-hand car from Arman's salesman which was two and a half years old, had driven 35,000 km, and was priced at RM40,850 by cash. He was informed by the salesman that the car has some problem exists in the clutch and the oil pressure but still, he insisted to trade in his motorbike for the car. He also agreed to repair all the defects by himself and bear all the expenses. After being driven for 80 km over two months without any doubt, Brahim brought it to a garage for service. Subsequent inspection revealed significant problems with the defect in the clutch and it was far more serious than either Brahim or Arman's salesman had imagined. Unhappy with the situation, Brahim wants to proceed with a civil action against Arman and his company claiming that they were selling non-merchantable and not fit-for-purpose goods.
