Of the cases you had to brief for this class, please define which had the most impact to the field of Dispute Settlement (Arbitration) and which had the most impact on the field of collective bargaining (Negotiations and Contract Administration). Of the cases we had to brief, the one with the most impact to the field of Dispute Settlement was Hines v. Anchor Motor Freights, Inc 47 L. Ed 2d 231 (1976) regarding the issue of fair duty of representation. In this case, petitioner employees were discharged by their employer for alleged dishonesty. Respondent union, claiming that petitioners were innocent, opposed the discharges and pursuant to the collective-bargaining contract the matter was submitted to an arbitration committee, which upheld the discharges. The District Court granted summary judgment for respondents on the ground that the arbitration committee's decision was final and binding absent a showing of bad faith or arbitrariness on the union's part. The main issue of the case is whether the Union violated fair duty of representation by arbitrarily and in bad faith depriving petitioners of their employment and permitting their discharge without sufficient proof? The court ruled that it was improper to dismiss petitioners' suit against respondent
