On November 22, 2022, Kyle Russo's brother Marcus was complaining to him about his cheap buddy, Roberto Devito, who had roped Marcus into helpin him move on Saturday rather than spending money on professional movers. Marcus promised that if Kyle helped with the move, Marcus would look after Kyle's Labradoodle Charley for the 5 days in February that Kyle was away on vacation. Marcus knew that Kyle didn't want to put Charley in a kennel because Charley had gotten kennel cough last time he was boarded and no one else in the family was likely to volunteer to look after Charley who was pretty rambunctious if he didn't get at least 3 walks a day. Kyle was happy with that deal and agreed to help with the move. Marcus called Roberto and told him that he had conned his brother into helping as well. Marcus would have looked after Charley anyway - he loved that dog almost as much as Kyle did. Roberto hired a van, booked the elevators at both apartments for 3 hours and promised to provide food and drinks on the day of the move. Kyle had Friday November 25" off work, so he decided to drive up to a conservation area and take his dog Charley for a nice, long, walk. They were walking on a lakeside trail when Kyle spotted Roberto and Marcus's girlfriend Amy walking ahead of him and holding hands. Kyle pulled out his cellphone, took a picture of the couple, and immediately texted the photo to Marcus. He then turned around and walked Charley back to his car. The next day neither Kyle nor Marcus showed up to help Roberto move. Roberto had to postpone his move until the 1s of December, hire movers, and pay a late cancellation charge for the moving van he had rented.
