The consumer Insurance contract Act 2019 states that warranties are no longer permitted in consumer contracts however the act transfers warranties in to suspensive conditions, meaning that an insurer can only suspend liability for the duration of the breach and if a breach is remedied by the time a claim occurs they would be liable to pay for this loss. AB Ltd are still correct in repudiating jim's own damage motor claim even though the warranty is now a suspensive condition. The fact remains that the suspensive condition was breached at the time of the accident.
