On December 4, 2020, Jeff Winger (Winger) fell in the lobby of Greendale County, Texas's Courthouse. Winger has retained our firm to explore the possibility of filing a premises liability claim against Greendale County to recover for the injuries he sustained in that fall. The Greendale County Courthouse is one of the oldest buildings in the county, and has been in continuous use since 1878. Due to its age, it requires near-constant maintenance and upkeep. One of the most difficult parts of the building to maintain is a massive tile mosaic mural installed in the floor of the lobby. The tile mosaic mural depicts important events in Greendale County's history, and it is routinely visited by scholars and history buffs. Several of the mural's tiles were broken during a renovation project in October of 2020. The County's maintenance staff repaired nearly all of the broken tiles, but inadvertently left two tiles unrepaired. In the winter of 2020, Wingerwho is a history professorvisited Greendale County to study its important role in Texas history. As part of his research, Winger visited the Courthouse to research historical documents in its archives and to photograph the tile mosaic mural. He paid a $5.00 fee to access the archives. As Winger left the Courthouse, he tripped over one of the two remaining broken tiles in the mural and fell, landing hard on his left elbow. Prior to Winger's fall, the County had not received any reports of falls or other injuries due to the mural's condition. However, the broken tile that Winger tripped onwhich has since been repairedwas located in a portion of the mural that nearly all of the Courthouse employees walk over every day, including the day of Winger's fall. The day before Winger's fall, another visitor to the County Courthouse, Annie Edison, noticed one of the broken tiles and reported it to a member of the County's maintenance staff. She expressed a particular concern that her young son could have cut himself on the exposed edge of the broken tile. It is unclear whether the maintenance worker reported Edison's concerns to any other County employee. It is also unclear whether the tile Edison reported is the same tile that caused Winger's fall.

As a result of the fall, Winger suffered a compound fracture in his elbow and damage to the ligaments in his left arm. Winger required surgery to repair the damage to his elbow. He cannot lift objects heavier than ten pounds with his left arm. He has already endured many months of physical therapy with minimal improvement. Winger's orthopedic surgeon recently informed him that he may never regain the full use of his left arm. He also faces an increased risk of arthritis in his left elbow.
