This agreement dated this 30th day of June, 2021 between Jalapenos, Inc. hereinafter referred to as "Caterer" and Jackson Jones hereinafter referred to as "Customer".

1. Customer agrees to pay for all guests attending but not less than for the number of guests guaranteed. Caterer may limit services to the number of guests guaranteed or the number of guests Caterer deems to be the maximum for the facility. Arrangement for additional guests and menu changes must be made at least ten (10) days prior to the event and such final guarantee, whether oral or written, shall be binding Customer as if originally guaranteed. In no event shall guarantee be less than originally agreed upon.

1. The charge for each additional person set up at Customer's request will be made and Customer agrees to pay at Caterer's established rate of $35 per person.

1. No event will be permitted to run over the time agreed upon without Caterer's approval. Caterer reserves the right to make reasonable additional charges for events running beyond the time agreed upon. This agreed charge is $100/hour.

1. In the event Customer cancels or otherwise breaches this agreement, Caterer shall retain $200 and/or any reasonable out-of-pocket expenses incurred by Caterer of the deposit for damages.

1. Any balance due will be paid in cash, certified check, Venmo or credit card charge within ten (10) days of start time of event.

1. Caterer reserves the right to substitute items that become unavailable in the open market or that exceed reasonable market costs. Caterer will notify Customer for approval if time allows.

1. Caterer and/or its agents shall be liable for any damage to property entrusted to its employees, for the loss of any property by theft or otherwise. Customer assumes responsibility for any damages to any property rented to Customer that may be caused by Customer, Customer's members, Customer's guests or Customer's invitees.

1. This agreement constitutes the entire agreement between the parties. No modification or cancellation thereof shall be valid nor of any force effect unless in writing signed by Caterer. The undersigned acknowledges that (s)he has read and accepted all the terms of this Agreement and had executed this Agreement on the 30^th day of June, 2021.

1. Security deposit for event shall be paid by Customer to Caterer at the time of the signing of this Agreement. Acceptable forms of payment include: cash, certified check, Venmo or credit card charge. Security deposit shall be 10% of overall cost estimate for event.

10. This agreement shall be governed and construed and enforced in accordance with the laws applicable to contracts made and to be performed in the jurisdiction in in which the Caterer resides.
