Lesher worked for the canine section of the Little Rock Police Department. He had donated a dog to the Department with a written agreement that he would be able to reclaim the dog if it became unfit for police work. However, after the dog bit a child, the Department did not allow Lesher to reclaim the dog and had it destroyed. Lesher made several complaints to the media. He was then transferred out of the canine section. Lesher sued, claiming the Department had violated his constitutional rights, claiming his transfer was in retaliation for his complaints.
