1. "You Be The Judge": Page 359 in the textbook. 2. Suzie is employed by Gedda Baulbat, Inc. A male co-worker, I.B. Pincher, constantly touches Suzie on the shoulders, the back and the arms. He also likes to make remarks about how she looks and that he would like to engage in sexual activities with her. Suzie complains to her supervisor, I. C. Nuttin, about the situation. He tells Suzie to deal with the problem. Suzie files a Title VII action for gender-based harassment against Gedda Baulbat. Does she have a claim? 3. Elvira applied for a job with the local TV station to host the Friday Night Horror Films. Elvira has had similar jobs with several other television stations, and has been fairly successful. There is no question that she is qualified to do the work. The television station hires Tommy Tune, a man, with limited experience, having served only as a clown on a children's TV show. Elvira files a sex discrimination claim under Title 7. After the facts that have been presented above are presented to the court, the television station seeks to have the case dismissed. What should the judge do? 4. George is sixty-two years old. He was recently terminated from his employment with IDLOP, Inc. The termination was part of a reduction in force caused by adverse economic conditions. IDLOP, Inc. retained several employees who performed the same job function as George. All of these employees were both younger and had less seniority than George. George was advised that these employees were retained because they were more productive than him. The company produced documentation to support this assertion. The company admitted that it was aware that by maintaining younger, less experienced employees, it would benefit the company (cheaper employees, who would likely stay with the company longer than George, who was approaching retirement eligibility), but insisted this was not a determining factor in the decision. A jury determines that the company is being truthful and brings in a verdict in favor of the IDLOP, Inc. George appeals. Does he win or lose
