She had purchased a ticket to participate in a mock pirate ship excursion tour in the Cayman Islands from E & H Cruises, a Cayman Islands corporation. While boarding the E & H mock pirate ship, Ms. Baker fell and was injured. She brought suit in Florida federal district court against both Royal Caribbean and E & H to recover for her injuries. E & H moved to dismiss the suit because it did not do business in the United States and was not subject to U.S. courts.
