2.The President has the power to nominate judges for the federal courts, including Justices of the Supreme Court.Since taking office, President Trump has had the opportunity to nominate two Justices to the Supreme Court, both of whom went through bruising confirmation processes.Has the confirmation process become too political?Should a prospective Justice's political background or judicial philosophy be taken into account in a confirmation process?Or should the focus of the confirmation process be on the prospective Justice's qualifications, abilities and experience?Do we risk making the federal courts more like legislatures if too much emphasis is placed on a prospective Justice's political background or judicial philosophy?
