1.Andy was shopping at an Office Depot store when he suddenly remembered he had an appointment with his Law 240 professor.Andy pulled his calendar out of his backpack to check the time, and quickly discovered that he was late for the appointment.Andy put the calendar back into his backpack and ran out of the store.As he exited, the security guard asked Andy to accompany the guard to an office at the back of the store.Andy went with the guard.Once there, the guard accused Andy of shoplifting and searched the backpack.The guard found the calendar, saw that it was already used and marked in, and apologized to Andy, explaining that the store had recently been experiencing an outbreak of thefts.The whole incident took less than five (5) minutes.Under these circumstances:

a. the Office Depot has a conditional privilege to stop persons it believes are shoplifting and the guard did not detain Andy for an unreasonable period.

b. Andy can sue the Office Depot for false imprisonment.

c. the Office Depot has no conditional privilege to stop persons it believes are shoplifting and will be liable for punitive damages.

d. Andy can sue the Office Depot for emotional distress and battery.
