1.In relation to their second claim, AD state that they have reason to believe that we are in breach of the Public Health and Safety (New Business Operations) Order 2020 (NSW)* ('Order'). It is our understanding that this Order wasn't enacted by the NSW Parliament. Rather, it is an Order made by the NSW Minister for Health mandating safe and healthy business practices. Can you please:

(a)Clarify whether orders, regulations and rules made by a government minister or department are legally binding; and

(b)Discuss whether you think the practice of executive law-making is consistent with the notion of representative democracy?
