1.Janzen v. Platy Enterprises, [1989] 1 S.C.R. 1252

The plaintiffs were two waitresses employed by the defendant. Another employee, a cook, continuously touched and made unwanted sexual advances toward them. The cook falsely told them that he had the power to fire them. The waitresses brought their concerns to management, but management did nothing. One of the complainants quit and the other was fired. The Human Rights Commission awarded one waitress $3500 in damages and $480 in lost wages, and the other $3000 in damages and $3000 in lost wages. The verdict was upheld on appeal by

the Supreme Court of Canada which took the opportunity to define sexual harassment non-exhaustively and broadly as "unwelcome conduct of a sexual nature that detrimentally affects the work environment or leads to adverse job-related consequences for the victims of the harassment." Thus, sexual harassment in the workplace constitutes sanctionable discriminations.
