Sandra, the company secretary for Acqua Peak Limited (APL) hired a SUV from Comfortable Drivz Limited (CDL) to transport Tom and Tenesha who were on business overseas and had to be transported from the airport to attend a board meeting. It is customary for Sandra to carry out such responsibilities with CDL. The vehicle was hired for five (5) days, two of which facilitated the directors going to and from the board meeting. For the remaining three (3) days, Sandra used the vehicle to take her relatives who were visiting from abroad on various sight-seeing tours across the island. CDL submitted an invoice for rental for five (5) days. Upon investigation, Tom and Tenesha realized that Sandra used the vehicle for her personal use for the additional three (3) days. APL is insisting that it is only liable to pay for two (2) days rental. However, CDL is demanding from APL full payment for the five (5) days that the vehicle was hired.
