Part 1 As a chef, Rita's dream is to own and manage her own restaurant on the Gold Coast. Rita's friend, Pamela, introduces Rita to Tony who makes a written offer to sell his restaurant in Southport to Rita for $600,000. Tony promises that the offer will remain open for 4 days only. Two days later, Tony phones Rita to tell her he has changed his mind. Rita who has been trying to arrange finance to buy the restaurant is very upset about Tony changing his mind. Rita is threatening to sue Tony. Can Rita still accept the offer and hold Tony to the sale?
Part 2 Rita needed to establish a contract for the cleaning of her tablecloths for her newly leased restaurant on the Gold Coast. Rita took forty white linen tablecloths to a Dry Cleaner in Burleigh Heads to be cleaned to evaluate the quality of their service. When Rita returned to the Dry Cleaners to collect the tablecloths, several of the tablecloths had orange rust spots all over them. They were ruined. A further ten tablecloths could not be found at all. The cashier said "It's not our fault. It says so right on your ticket." On the back of the ticket was printed the following clause, "Best Dry- Cleaning Services Pty Ltd will not be liable for any loss or damages to articles left for cleaning whether caused by negligence of servants or agents of the company or otherwise. Advise Rita if she will be successful in claiming damages against Best Dry -Cleaning Services for the loss and damage to Rita's linen tablecloths.
Part 3 Rita had a five- year written lease of a restaurant in the Gold Coast Mall. Rita entered the lease paying $1600.00 per week at the end of 2021. The Restaurant was a successful business for 2.5 years. However, in 2024 the restaurant was affected by a series of food poisoning incidents which led to a serious loss of customers. In December 2024, Rita asked the Lessor GC Mall Marts Pty Ltd for a reduced rental of $1200.00 per week until the restaurant business improved. Rita told the Lessor about her business problems and plans to diversify and indicated she might have to terminate the lease early. GC Mall Marts Pty Ltd agreed to allow Rita to pay the reduced rent and in January 2025 Rita began to pay GC Mall Marts Pty Ltd the reduced rent of $1200.00. In December 2025, GC Mall Marts Pty Ltd decided to sell the mall, including all shops. GC Mall Marts Pty Ltd wanted the income from the Mall to look healthy, and asked Rita to pay the full amount of $1600.00 per week beginning in January 2026 and also demanded the shortfall of $400.00 per week for each week of 2025. Advise Rita if she must repay the $400.00 per week shortfall for each week of 2025 and the full amount of $1600.00 per week as from January 2026.
