It involves relying on case law (precedents) and formulating a legal test of factors or elements that must be met. There are five general elements for a successful claim in negligence (Unintentional Tort): (1) there must be a duty of care (2) the duty of care was breached (3) there is causation (4) there is quantifiable harm and (5) Remoteness. However, in (Intentional Tort) there are three elements (1) Wrongful act or omission (2) Causation and (3) Quantifiable harm.
