3. Hung Huynh is a nurse at the public hospital Gotham Health Services (GHS) and very much unhappy with the work conditions in the hospital since the pandemic hit. Hung Huynh and his partner, Leo a doctor at GHS, have seen negligence, fraud and surveilling in the way GHS has managed the COVID disaster. Upset with all this knowledge, Leo starts blogging under the moniker Death Doc-l-Am-Not and begins to leak internal emails from the leadership at GHS urging their employees to not share the true conditions of the hospital for fear of losing federal funding. Leo even begins to record footage of the patients and their conditions, either broadcasting Live on Meta (f/k/a Facebook) or scrubbing the footage to highlight his blog. GHS finds out about Leo's blog and terminates his employment; and to make an example of the situation also terminates Hung Huynh's employment. after they hacked into both professional and personal Office accounts finding evidence of Hung Huynh's Bing searches for "EEOC", "OSHA" and "Title IX". One email GHS read was sent from Leo's work laptop to a local journalist, in where Leo mentioned that the hospital they worked at turned an entire public lobby into a ward for treating patients with the virus. Adding insult to injury, the journalists received the names and date of births of the COVID patients, warning the public to avoid any and all contact from the listed "dirty spreaders over at the Gotham Health who clearly have not been vaccinated and are harming America's future, autonomy and sacredness of the Constitution." The journalist also takes various selfies around the hospital to use on an expose piece they plan for GHS for The Onion is three weeks during Thanksgiving when families are primed, unexpecting of the release of a piece documenting the carelessness at GHS during COVID. What Constitutional Law considerations are listed here? What is the legal treatment of each of those considerations? 3.
