3.30. Sally is issued a progress claim for another stage of works, the fixing stage in the sum of $35,000. She fails to pay by the due date and cites that she is running out of money. Harry decides that he needs to put Sally on formal notice that he may end the contract because of this default. Using the sample Home Building Contract, prepare a breach notice to send to Sally. Dear Sally Last Name, We write to inform you that as per clause 27, subclause 27.2 you are currently in breach of your contract for failure to meet the required due date of your progress payment on xxxxboxxx. We note that this progress payment is currently xx days overdue and as per the agreed contract, clause 17, these payments are due within 5 days. As per clause 27, should this not be remedied within 10 business days, the contract may willfully be terminated. Kind Regards, Harry Last Name 3.31. After Harry issued the breach notice, Sally still did not make payment leaving Harry no choice but to get legal advice and bring the contract to an end. What would need to be sent to Sally advising her of this decision and how should any notification be sent? Review the breach/ termination clause of the contract and notice provisions
