Kyle owns a small commercial building. He uses part of the building as his law office, and rents out the remainder of the building to Mary under a fiveyear, definiteterm lease. Mary operates her real estate business out of the building and frequently visits with clients in the space, including on evenings and weekends. The entrance to the building is equipped with a handicapped accessible, automatic door opener. The automatic door opener is not working properly. The door will open initially, but does not stay open long enough for someone to get completely through the doorway. Mary reported the problem to Kyle one month ago, and Kyle told Mary that he would send someone to look at the door. Today, on of Mary's clients used the automatic door opener and the door swung closed before they made it through the doorway and knocked them to the ground. The client was severely injured in the fall. As between Mary and Kyle, who will be liable for this injury? Why?
