4. Lori is about to open her first art gallery. On April 1, she contracts with her good friend Pat to show 20 original paintings on its opening night, August 1. Pat immediately gets to work ordering paint and canvases. The first shipments arrive and Pat begins working. Sometime later, Pat spills some of the paint. She immediately orders more, paying extra to ensure its arrival by June 1. The paint does not arrive on June 1, and despite repeated promises by the paint supplier, Kathy, that it would be arriving any day, it arrives over 30 days late. Pat is at her wits end after a month of unsuccessful attempts to procure paint in a timely manner by other suppliers and by Kathy. She tells Lori she will do her best to complete all 20 paintings (as it is too late for Lori to hire another painter), but is only able to complete 11 paintings in time for the opening. As a result, Lori has to cancel the opening, because she doesn't have enough paintings to show. She loses over $2,000 in advertising costs, as well as $3,000 of pre-ordered food and drink that she cannot get refunded. Pat wants to sue the paint supplier, Kathy, for the lost profits she would have earned on her paintings, and Lori wants to sue Pat for the cost of cancelling her opening. Pat estimates she would have earned $1,000 per painting. She also wants a refund for the cost of the paint. Pat meets with Attorney Hennessey and Lori meets with Attorney Creaser.
