Dear Chandra,

SHOW CAUSE TO TERMINATION OF EMPLOYMENT

This letter is to advise the outcome of the meeting held with you on 28/05/2024 at 1130 hours via Microsoft

Teams.

On 24 May 2024 you were provided with a letter with details of allegations raised against you and sufficient

notice to attend a formal meeting to be held 28/05/2024.

On DATE you attended a formal meeting where you responded to the allegations. You chose not to bring a

support person to the meeting.

We have carefully considered your responses and have come to a conclusion in relation to all allegations

associated with the particulars detailed in the letter of 24 May 2024. I will not detail the particulars again;

however, I will include references to your responses where relevant.

Below we have outlined the findings of the allegations:

Alleged failure to adhere to RSL LifeCare Manual Handling procedures

This allegation is substantiated based on your own statement during the formal meeting.

Alleged failure to adhere to RSL LifeCare Policies and Procedures

This allegation is substantiated based on your own statement during the formal meeting.

Alleged Failure to adhere to the RSL LifeCare Code of Conduct

This allegation is substantiated based on your own statement during the formal meeting.

Alleged breach of the Aged Care Standards as per the Aged Care Act 1997.

This allegation is substantiated based on your own statement during the formal meeting.

Regarding the specifics of particulars one and three, you mentioned that you chose not to follow the proper

manual handling protocols and did not adhere to the resident care plan because you observed that other, more

senior team members were also not doing so. During the formal meeting, you expressed your apologies and

acknowledged that by making such decisions, you understand you were putting the residents at risk.

Regarding particular number two, you stated that you took a personal call for a job interview while providing

care for a resident. You acknowledged your mistake and expressed remorse by saying, "I am sorry for this; I did

something wrong.

I note that on 7/05/2024 you received a warning letter for failing to adhere to RSL Lifecare's manual handling

procedures and neglecting to follow resident care plans, actions which put our residents at risk of injury or

death. Consequently, you were placed on a Performance Improvement Plan (PIP), which you signed and dated

07/05/2024. The PIP was specifically focused on addressing these areas of concern.

The allegations that have been substantiated against your raise serious concerns regarding your ability to

provide a safe environment for our residents. Your willful intention to breach RSLLC's Manual handling

procedures and lack of awareness of the potential physical harm you could cause is of concern. Additionally,

the potential reputational risk to RSLLC.

After careful consideration we have determined by engaging in this conduct, you have breached RSL LifeCare

Policies and procedures. We believe your conduct constitutes serious misconduct and has caused serious and

imminent risk to our residents which is inconsistent with the continuation of your contract of employment.

Consequently, we have lost trust and confidence in your ability and practice as a Carer at Mark Donaldson VC

House. On this basis, we are considering termination of your employment.

We now provide you with an opportunity to show cause to termination and provide us with reasons as to why

your employment should not be terminated by Tuesday 11 June 2024. If you fail to provide a response by

5:00pm Tuesday 11 June 2024, we will make a decision with the information currently available.
