4. The petition for rehabilitation shall be dismissed when the following is present, except:

a. The petition is a sham intended only to delay the enforcement of the rights of the creditor.

b. The debtor has committed acts of misrepresentation or in fraud of the creditors.

c. The debtor is solvent.

d. The petition contains materially false or misleadings statements.
