This is an actual case that occurred in Vancouver, BC, about 12 years ago. Your challenge is to discuss the facts and come to a conclusion: is this lawsuit worth fighting (.e. you have a decent defence), or should you move to settle (i.e. the plaintiff has a solid case and is likely to win). Facts: a homeowner in a wealthy neighbourhood decides to take advantage of a new city bylaw that allows for the building of a second structure on a large lot that can be rented out. This owner does exactly that: he converts his garage (which opens onto a lane) into a four bedroom house behind his own house. Once finished, he rents it out. The back house can be accessed both from the lane and from the street via a walkway that passes along the side of the original house. One night, the tenant at the back comes home. He gets off the bus on the street. He walks up the walkway to his house, past the original house. Just as he passes a large window, there is a shout of joy, much cheering, and clapping, from inside the front house. He glances at the window, sees there's a party going on for a child, and keeps moving towards his own residence. Four days later he is served with a tort lawsuit accusing him of trespassing.
