A new engine was required; however, Donley installed the wrong engine. The entire job had to be done over at the cost of hundreds of dollars. Stahl brought suit against LePage. Her argument was that she should be able to recover against LePage for the misdeed of Donley, because he had the apparent authority to act as LePage's agent. Lepage disputed this, saying that the facts did not warrant a finding of agency under any theory
