6. The Case of the Two Sisters. Robert Briggs and Shirley Briggs were the record owners of a home located at 167 Lower Orchard Drive in Levittown, Pennsylvania. They had originally bought this house in 1955 for $11,600 by making a $100 down payment and borrowed $11,500 with a 30-year mortgage requiring payments of $82/month. In late 1961, Mr. and Mrs. Briggs were in financial difficulty, were unable to pay the mortgage and other home-related expenses and they moved out of the house. Several months later, in early 1962, the Briggs arranged with the Sacketts to move into the house. Mrs. Sackett and Mrs. Briggs were sisters. At this time, the Briggs and the Sacketts entered into an oral agreement based on which the Sacketts moved into the Briggs' house and paid the three months of delinquent payments due on the Briggs' mortgage. The Sacketts also agreed to make the future payments on the mortgage. No written documents were ever executed regarding this arrangement and the Briggs continued to hold record title to the property on the official records. The Sacketts lived in the house making the monthly mortgage payments and paying all other expenses relating to the property from 1962 through 1976. In 1976, Mr. Briggs filed a lawsuit seeking to evict the Sacketts from his house.
