8. Otto gets referrals to do house painting jobs. When he gets one, he goes to visit the house, works out a contract with the homeowner to get the building painted, and then does the painting. When Otto secures a contract for work, the referral agency gets 10 percent of what he gets paid. During one job, Otto accidentally knocks a bucket of paint onto the owner's tiny, expensive dog. The dog is drenched and needs very elaborate grooming to get the paint re-moved. The owner of the property sues the referral agency. Will the agency prevail on a motion to dismiss for the cost in damages to cleaning up the dog? Why or why not?
