Victim and Debbie return to Two Timer's house after a date whereupon Victim gives Two-Timer a romantic hug and a long and passionate kiss, at the doorway to the home. Unbeknownst to both of them, Defendant who had returned early from his business trip, had let himself into Two-Timer's home hoping to surprise her with a bouquet of roses. Defendant sees them hug, and he is overcome with jealously. He then runs up to Victim and tries to separate him from Debbie, crying out "she's mine!" Mr. Victim then punches Defendant in the face, yelling "get off of me!" Defendant, who is incensed and bleeding from his nose, runs back into the home to the kitchen, where he retrieves a large butcher knife. Victim runs into the home, and he attempts to disarm Defendant. In the confrontation between the men, Mr. Defendant swings the knife one time at Victim's neck, where the knife impales into Mr. Victim's carotid artery. Victim "bleeds out," in less than a minute in the living room. Mr. Defendant flees the scene. Running from the house, Defendant tosses the butcher knife into the sewer. Defendant is later apprehended by the police hiding in a nearby wooded area. Ms. Two Timer runs to the woods, and yells to Defendant, "I love you, please forgive me!" As Mr. Defendant is being loaded into the police squad car, he yells to the police, "I invoke my Miranda rights to remain silent!"
