A 70-year-old man (Mr. Coblyn) went into a department store in Boston and, after some shopping, purchased a sport coat. After leaving it for alterations, he put back on his hat and topcoat and began to exit the store. At the doorway, he put an ascot around his neck (which he had brought into the store with him) that was in his pocket. Just outside the door he was immediately and roughly stopped by a store employee who demanded to know "Where did you get that scarf?" He was ordered in a loud voice (heard by several other customers) to go back into the store and "See the manager." On the way to the manager's office, the salesman who had sold Mr. Coblyn the sport coat saw him and assured the other store employee that the ascot belonged to Mr. Coblyn. At that point, Mr. Coblyn experienced chest pains and was hospitalized for a heart attack. He subsequently sued the store for false imprisonment.
