The mother told the nurse, Carla Caring, RN, that she had removed 2 ticks from one of the children. Ms. Caring, RN, documented this information on the children's charts but did not verbally tell Dr. Georgia Good, the independent ER physician about the ticks. The physician failed to review the documentation and in the absence of this history, she diagnosed the children with measles. The younger child, Paul Pain, Underline (U) died 4 days later of Rocky Mountain Spotted Fever. The older child, Paula Pain, was subsequently treated and cured, but sustained a limp that resolved within 6 months. The plaintiffs filed a medical malpractice lawsuit against the nurse, Carla Caring, RN and her employer, Holiday Healthcare Corp, d/b/a Healing Heart Hospital, alleging that the nurse knew the ticks had been removed from one of the children and that the nurse was negligent in failing to inform the ER physician of this information. (The ER physician was initially sued, but she settled out of court.) The defense from Carla Caring, RN, and her employer, Holiday Healthcare Corp. d/b/a Healing Heart Hospital, was that it was the independent ER Physician's (Dr. Georgia Good's) duty to find out about the ticks.
